Calmatte

Terms of Use

This is the agreement between you and Appè Latte for using Calmatte. It is also the End User Licence Agreement (EULA) required by the App Store.

Read this first: Calmatte is not medical care. It is a journalling and self-reflection app. It does not diagnose, treat, cure or prevent any condition, it is not a medical device, and it is not a substitute for a doctor, therapist or crisis service. If you are in danger or thinking about harming yourself, contact your local emergency number or a crisis line now. The app keeps a list of them under the First Aid Kit.

1. The agreement

These terms are a binding agreement between you and Appè Latte ("we", "us"), of Alberta, Canada, covering the Calmatte iOS application and calmatte.app (together, "Calmatte"). By downloading or using Calmatte you accept them. If you do not accept them, do not use it.

Our Privacy Policy forms part of this agreement.

2. Your licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to use Calmatte on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules. This is a licence, not a sale — we keep ownership of the app.

You may not: copy, sell, rent, sublicence or redistribute the app; reverse engineer, decompile or disassemble it except where that restriction is prohibited by law; remove any proprietary notice; or use it in a way that breaks any law.

3. Who can use it

You must be at least 13 years old. If you are in the EEA or the UK and under 16, you need a parent or guardian's consent. If you are using Calmatte under 18, we assume a parent or guardian has agreed to these terms on your behalf.

4. Your account

You are responsible for keeping your sign-in details secure and for what happens under your account. Tell us at support@appe-latte.ca if you think someone else has access to it. You can delete your account at any time from Settings; see the Privacy Policy for exactly what that removes.

5. What Calmatte is not

In plain terms Calmatte helps you notice things about yourself. It is not treatment, and it cannot tell whether you are safe.

Always seek the advice of a qualified health professional about a medical condition. Never disregard professional advice or delay seeking it because of something you read in Calmatte.

6. Matte and AI

Matte answers questions using an AI model that runs on your device, working only from entries you have written. AI output can be wrong, incomplete or misleading. Do not rely on it for any decision about your health, safety, finances or legal position. Matte is not a therapist and does not provide therapy. Free accounts have a daily message limit; a subscription removes it.

Matte will not discuss, encourage or help you plan self-harm, suicide, harming another person, or sexual activity, and will not quote your own entries on those subjects back to you. Where what you have written suggests you may be in danger, it stops and points you to real help instead of replying.

Calmatte does not monitor you on anyone's behalf and does not alert anyone. It notes on your device that an entry looked concerning, so that a session brief you choose to create can tell a clinician the dates. You see that note before you send it and can switch it off. Nothing is reported to us, to any service, or to any authority — and the app cannot summon help. See the Privacy Policy for exactly what is recorded.

7. Sharing with other people

Calmatte lets you create an expiring link to a session brief, or export a PDF, to share with a clinician or anyone else you choose.

8. Subscriptions and payment

Calmatte is free to use, with an optional Calmatte Premium subscription offered as a monthly or yearly auto-renewing subscription, and in some regions as a one-time lifetime purchase. Exact prices are shown in the app before you buy, in your local currency.

Losing a subscription does not delete your entries. They remain in your account and stay exportable.

9. Acceptable use

Do not use Calmatte to break the law, to store or share content you have no right to, to attempt to gain access to another person's account or our systems, to probe or overload our infrastructure, or to abuse the sharing feature to distribute material unrelated to your own wellbeing. We may suspend or end access that does any of these.

10. Your content

What you write is yours. We claim no ownership of your entries. You grant us only the narrow permission needed to run the service for you — to store your content, sync it to your devices, back it up, and deliver a brief to a link you created. We do not use your content to train AI models, and we do not use it for advertising.

You are responsible for keeping your own copies of anything you would be upset to lose. Use the export feature.

11. Our intellectual property

Calmatte, its name, design, artwork, text and software are owned by Appè Latte and protected by copyright and other laws. These terms give you no rights in them beyond the licence in section 2.

12. Availability and changes

We aim to keep Calmatte working but do not promise it will always be available or error-free. We may change, suspend or discontinue features. If we discontinue the service altogether, we will give reasonable notice in the app so you can export your data first.

We may update these terms. If a change materially affects you, we will tell you in the app before it takes effect. Continuing to use Calmatte after that means you accept the new version.

13. Ending this agreement

You may end it at any time by deleting your account and removing the app. We may end it if you materially breach these terms, with notice where reasonably possible. Sections 10, 11, 14, 15 and 17 survive termination.

14. Warranty

To the fullest extent permitted by law, Calmatte is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that it will meet your requirements, be uninterrupted, or be free of errors.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these terms limits your rights as a consumer under the laws of your own country, including the Alberta Consumer Protection Act where it applies.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Calmatte. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $50.

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

16. Apple-specific terms

These terms are required because Calmatte is distributed through the App Store.

17. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Alberta have jurisdiction, except that you may bring a claim in the courts of your own country of residence where the law gives you that right.

If any provision is found unenforceable, the rest remains in force.
